Advice On Claiming Medical Negligence Compensation

May 12th, 2012

One of life’s inevitable occurrences is that everyone will need to see a physician, or need hospital treatment, at some point. Some predicaments will require surgical intervention, and that will involve an element of risk. This element should be explained to the patient by the physician, if it is not, and complications arise, the patient has full right to file for medical negligence compensation.

These elements of risk can always be affected by unforeseen factors. Health care professionals might be highly trained people, but at the end of the day they are still people, and as such are just as likely to make a mistake as the next person. Health care professionals have what is known as a duty of care towards the patient.

Every year it is estimated that there are nearly 200,000 deaths caused in American hospitals by either malpractice or neglect. This makes these the third highest cause of death, behind heart attacks and cancer. Yet only a few claims are ever pursued.

To win a lawsuit, the onus falls largely on the individual to prove that the injury was a direct result of substandard care. They would initially have to determine that their injury was indeed caused by carelessness. As there is no legal requirement for a physician to admit to an individual that the care they were given was in fact substandard, it will often lead to a consultation with an alternate physician.

Should the patient be under the care of multiple health care providers, then they also need to determine exactly who is responsible. There is also the time constraint to be aware of. Any claim for neglect has to be brought within a set period of time, and this can vary from state to state.

If the thought of pursuing medical negligence compensation fills you with dread, help is at hand. There are many legal practices that specialise in these types of negligence claims. They have teams in place, often including their own physicians, making things so much easier for you.

How To Handle Car Accident Claims

November 3rd, 2011

Being involved in a car collision is not just dangerous but scary for everybody involved. The process of handling the aftermath in preparing car accident claims can be a bit of a slow process but, if you prepare yourself by being as organized as possible it can be a lot less daunting.

First and foremost, make sure that all people involved are safe. If anyone is a need of medical assistance ensure you get them assistance as quickly as possible. Once certain that nobody is in danger begin collecting insurance information.

Take snapshots of both cars involved and remember to include the area that surrounds the incident. Grab a notebook or piece of paper and jot down everything that you remember happening. If there are any witnesses are willing to discuss what they saw then asked them to share with you their memories of the incident. If anyone from your car has required a doctor’s care be sure to get a copy of the record.

Call your insurance representative and have them come to the scene to write a report. If occupants of the other vehicle are willing to wait for the insurance representative, this can be very helpful. Your representative will also take pictures and notes, at this time you could offer them all with the details that you remember.

It is in your best interest not to focus on a monetary value as things are getting sorted out. While claim is being filed with the company there may be changes in the amount of compensation you are awarded so, it is important not to rush the process.

It will take a while for your claim to be processed and it is important to recognize that just because you are entitled to some compensation, does not mean you will necessarily get what you feel you deserve. If unsatisfied with the company’s offer you may want to consider appealing the decision or in some cases, even consider contacting a lawyer for further advice.

If you have been involved in an incident on the road, find solicitors who will help you make car accident claims for no win no fee compensation.

Drunken Pensioner Arrested For Drunk Driving At 4mph

September 15th, 2010

Eight policemen in three police cars have made an arrest of a man driving after consuming three times the legal drink driving limit. The man was pulled over as he made his way home from a local pub, on his mobility scooter.

The pensioner, travelling at around 4mph on a pavement close to his Chesterfield home was surrounded by the policemen when he failed to stop. One policeman thought it necessary to mount the pavement with his vehicle to prevent the pensioner from continuing his journey whilst another took his keys.

Eamonn Donohoe, 62 of Chesterfield was travelling at around 4mph on a pavement near his home when police surrounded him, preventing him from completing his journey home. Mr Donohoe, who is disabled due to blocked arteries in his lower legs, was pulled over after spending a pleasant evening at his local pub playing dominoes with friends. He had consumed around six or seven pints before leaving for home.

He was kept in police cells for 12 hours, fingerprinted and had his DNA taken. Mr Donohoe commented “Anybody would think that I was a bank robber or a member of Al-Qaeda, I can’t believe how they treated me”.

He continued; “They must have known, like I did, that the rules of the road don’t apply when you’re riding a mobility scooter down the pavement at three and a half miles an hour, but it didn’t seem to matter one jot.”I didn’t stop at first because I wanted to get home, and I wasn’t doing anything wrong.”

Mr Donohoe was found to be three times over the legal UK drink driving limit after he failed a roadside breath test. He has been banned from driving; however he has not been banned from driving his mobility scooter as it is not actually classed as car.

There are several unusual cases of drink driving, including a milk man charge with driving his float whilst under the influence and a Welsh rugby player driving a golf buggy down a busy motorway.

Driving Bans: The Facts

July 24th, 2010

A disqualification from driving can range from one year to ten years depending on the severity of the offence. There are also cases where a judge will rule that the offender should serve a lifetime disqualification to avoid putting the lives of others at risk.

There is also something called a Short Period Disqualification (SPD ) which means you are banned from driving for less than 56 days, during which time the court will have custody of your driving license, but it will not be surrendered. This penalty is usually given for less severe offences, and you can start driving once it has expired, without taking your test again

When a full license disqualification has been given and completed, you are able to apply for a license again, using forms available at the post office and online. If you do this you will be issued with a provisional licence and then need take the theory, hazard and practical tests in order to regain a full licence.

The endorsements of a disqualification will remain on a licence unless otherwise instructed by a magistrate for which you will need to appear and present your case for removal.

In some cases of extended bans, you may not be banned for the whole period, as the court sometimes allow a driver to serve half their disqualification if they have taken steps to ensure that after the disqualification period they can be a safer driver, such as a drink driving rehabilitation course. A ban may also be reduced if the court take into account the motorists personal circumstances and deem that the impact of the ban would be detrimental to the motorists family life or job.

For bans longer than 2 years you can apply after half the proposed disqualification period, for example for a ban of 6 years you can apply after 3. If you made other offences, driving or otherwise, since your disqualification the court will immediately dismiss your application. If you are caught driving whilst banned you will face a custodial sentence and a hefty fine.
